Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and Mercurious, LLC, a Missouri limited liability company doing business as PawnShopper (“PawnShopper,” “we,” “us,” or “our”). They govern your use of the PawnShopper websites, applications, and services (together, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What PawnShopper is

The Service has three parts:

  • A public pawn shop directory — shop profiles, locations, and related information that anyone can browse without an account.
  • Merchant tools — subscription software that pawn shop merchants use to manage their shop profile, publish item listings, and respond to consumer messages.
  • Consumer features — browsing, search, favorites, saved searches, and messaging that let consumers discover shops and items and contact merchants.

PawnShopper is an information and software platform only. We do not buy, sell, pawn, appraise, ship, or hold any item, and we do not process payments between consumers and merchants.

2. Accounts

Browsing the public directory does not require an account. Account features (merchant tools, favorites, saved searches, messaging) require signing in. Authentication is provided by Auth0; you are responsible for maintaining the security of your login credentials and for all activity under your account. You must provide accurate account information and be at least 18 years old to create a merchant account. Notify us at [email protected] if you suspect unauthorized use of your account.

3. Merchant subscriptions and billing

  • Plans. Merchant tools are offered on subscription plans (including a free tier). Plan features, limits, and prices are shown at the time of purchase and may change with notice for future billing periods.
  • Trials. Paid plans may include a free trial. If you cancel before the trial ends, you will not be charged. If you do not cancel, the subscription converts to a paid subscription at the end of the trial.
  • Billing. Paid subscriptions are billed through Stripe on the cadence you select (monthly or annual) and renew automatically until canceled.
  • Cancellation. You can cancel at any time through the Stripe Customer Portal, reached from your billing page. Cancellation takes effect at the end of the current billing period. See our Refund Policy for refund terms.

4. Acceptable use

You agree not to misuse the Service. In particular:

  • Merchants must keep listings accurate and current — item condition, pricing, and availability should reflect reality.
  • Do not list or promote illegal goods, stolen property, or items whose sale is restricted in your jurisdiction.
  • Regulatory compliance is the merchant’s responsibility. The pawn industry is regulated at federal, state, and local levels (licensing, holding periods, reporting, firearms rules, and more). Merchants are solely responsible for complying with all laws and regulations that apply to their business. PawnShopper does not verify compliance and provides no legal advice.
  • Do not scrape, harvest, or bulk-download directory data; probe or disrupt the Service; misrepresent your identity or affiliation; or use the messaging system for spam, harassment, or unlawful conduct.

5. Consumer–merchant interactions

PawnShopper is not a party to any interaction or transaction between consumers and merchants. Listings are informational — they are not offers by PawnShopper, and we make no promises about the availability, condition, authenticity, legality, or price of any item. Any purchase, pawn, trade, or other transaction happens directly between you and the shop, on the shop’s terms, typically in person at the shop. Deal with shops at your own discretion.

6. Your content

Merchants retain ownership of the content they submit (shop details, listings, photos, messages). By submitting content, merchants grant PawnShopper a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content for the purpose of operating and promoting the Service — for example, showing listings in the directory, in search results, and in previews. You represent that you have the rights to the content you submit and that it does not infringe anyone else’s rights.

7. Directory data and corrections

The public directory includes shop information compiled from public sources as well as merchant-provided data. We work to keep it accurate but do not guarantee it. If you are a shop owner and your listing is incorrect, you can claim your shop through the merchant sign-up flow or request a correction at [email protected].

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DIRECTORY OR LISTING INFORMATION IS ACCURATE OR COMPLETE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MERCURIOUS, LLC AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE — INCLUDING ANY TRANSACTION OR INTERACTION BETWEEN A CONSUMER AND A MERCHANT. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED US DOLLARS ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Termination

You may stop using the Service, and consumers may delete their account from account preferences, at any time. We may suspend or terminate access to the Service (or any account) if these Terms are violated, if required by law, or to protect the Service or its users. On termination, sections that by their nature should survive (including content licenses needed to wind down, disclaimers, limitation of liability, and governing law) survive.

11. Governing law

These Terms are governed by the laws of the State of Missouri, USA, without regard to conflict-of-law rules. Any dispute arising out of the Terms or the Service will be brought in the state or federal courts located in Missouri, and you consent to their jurisdiction and venue.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above, and for material changes we will provide additional notice (such as email to account holders or an in-product notice). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
